Guide for Content(Image) Creation

  • Please check image copyright before creating products.

    When you register a product on MarppleShop, you must comply with the content’s copyright, portrait rights, intellectual property rights, and terms.
    The copyright of the registered contents belongs to the creator, and buyers can only use the image for non-commercial purposes.
    Liability for registered digital goods belongs to the creator.
    As MarppleShop does not own the copyright of the creator’s content, MarppleShop is exempted from any liability deriving from the content’s sales, etc.
    The creator is responsible for all disputes deriving from the use or sale of third party’s content without permission.
    As using files downloaded from portal sites or free/charged image sites are clearly against copyright policies, you must not upload them.
    It is illegal to upload images from others or others’ sites.
    If the uploaded image violates trademark, design, and intellectual property rights by featuring people(portrait rights) or a certain brand logo, landmark, product image, or character, it cannot be sold.
    Drawing an influencer/celebrity or tracing an existing artwork is not permitted for sales.
    Copying a certain brand, product design, or character design may be a violation of design intellectual property rights and, therefore, cannot be sold.
    When the creator violates regulations mentioned above or causes copyright/intellectual property rights infringement, MarppleShop can suspend sales or freeze the creator’s account without notice to prevent further conflicts.

  • What kinds of images cannot be sold?

    MarppleShop prohibits the use of images containing the following:

    1. Content that violates copyright, portrait rights, and property rights of third parties

    MarppleShop is not responsible for any legal disputes arising from the use or sale of third party’s content without permission, and the liability belongs to the creator who sold the image.

    1. Content that features pornography, defamation, and other illegal or immoral materials
    2. Content against public morals, featuring crime, violence, child abuse, sexual expressions, etc.
    3. Content that features antisocial, socially worrisome materials
    4. Content that depreciates or discriminates against a person or animal
    5. Content portraying illegal or violent actions
    6. Content regarding animal abuse or violence against animals
    7. Content that encourages suicide, self-injury, or drug abuse
    8. Content that may be interpreted as an attack to a certain nationality, religion, or group and cause displeasure
    9. Fraudulent advertisement or content that causes unfair competition
    10. Content that includes parts of a certain trademark, design mark, business name, and logo

    When problems arise from uploading an image as such, any relevant liability belongs to the creator who uploaded the image. MarppleShop does not stand surety or take responsibility in any case regarding the creator’s image upload.

    Copyright of the content of the product sold in MarppleShop belongs to each shop owner(creator), and the responsibility for any issues arising from copyright infringement also belongs to each creator.
    MarppleShop restricts registration of products featuring contents that are owned by others, go against public morals, cause displeasure, include abusive expressions, encourage ultranationalism, etc.

    1. Content against public morals that features crime, violence, child abuse, sexual expressions, etc.
    2. Content containing antisocial materials
    3. Content that may cause public censure
    4. Content thatdepreciates or discriminates against a person or animal
    5. Content that uses harsh epithet or abusive language
    6. Content that encourages suicide, self-injury, drug abuse, etc.
    7. Content that encourages or may encourage discrimination
    8. Content that may be interpreted as an attack to a certain nationality, religion, or group and cause displeasure 

    2. Plagiarism such as copyright or trademark rights infringement
    1. Content Violating Copyright
    - When you use someone else’s literary property(character, photograph, image, font, copy, etc.) without the copyright holder’s permission
    - When you use someone else’s literary property or when the character, movement, composition, arrangement, or way of expression are practically similar to the extent that it’s considered plagiarism

    2. Content Violating Trademark Rights
    - When you use a trademark that is similar or equivalent to someone else’s registered trademark
    - When you use the trademark or name of a domestically known person although it is not someone else’s registered trademark (corresponds to  the act of unfair competition)
    - When you use content deemed improper by the company, or when there is a chance of infringing on others’ rights by using the content

    3. Content Violating Portrait Rights or Publicity Rights 
    - When you use others’ portraits without permission 
    - When a certain figure can be clearly associated (public figure, celebrity, etc.) by mentioning the name, for example
    * We ask for your understanding in that we cannot provide specific guidelines as the standards for publicity rights are still ambiguous in Korea.

    4. Others: Tracing or Parody
    - When the content reminds of or cites existing contents like cartoons, movies, dramas, etc.
    - When the content reminds of or cites original contents or certain figures’ behaviors
    (ex. when a certain choreography and lyrics simultaneously get exposed, when a certain action and buzzword simultaneously get exposed, etc.)
    - When you use original contents through rotoscoping technique

    Apart from the mentioned guidelines above, MarppleShop can restrict, suspend, change, or terminate the sale of products that are considered improper by the company or that received reports. 
    It is the same for products that received reports and then were deemed improper.

    * What is “literary property”?
    Literary property refers to a creation that expresses ideas and emotions.
    Copyright registration is not mandatory since copyright is given immediately as the literary property is created.
    However, literary property can receive protection according to the copyright law when copyright registration takes place. Please refer to the “<span class="colour"><u>Korea Copyright Commission</u></span>” for relevant information.

    *What is a “trademark”?
    It is a mark used to distinguish one’s own product from others’.
    The mark could be a symbol, character, shape, sound, scent, three-dimensional form, hologram/action, or color. Besides, any mark-- regardless of its composition or way of expression-- that is used to display the source of a product is possible.
